ABOUT THE SPEAKERS


JAMES M. MAROVICH

James M. Marovich is a litigation and transactional attorney who, before solo practice and forming his own firm, worked for two multi-state law firms in Phoenix and Scottsdale.

Mr. Marovich’s entertainment law practice consists of copyright, trademarks and trade names, and rights to privacy. He provides business, intellectual property, and contract law services for singers, songwriters, musicians, bands, independent film companies, publicists, actors, talent and modeling agencies, authors, artists, photographers, physicians, medical spas, theatre companies, talent management, and record sales and distribution services companies.

Prior to legal practice, Mr. Marovich had over twenty years of senior hospital administrative experience. He has served on numerous not-for-profit boards, is a frequent speaker for the Arizona Songwriters Association and community college performing arts classes, and is currently serving as general counsel for the Arizona Music and Entertainment Hall of Fame. He is a member of the Executive Council of the Intellectual Property Section of the State Bar of Arizona.

Coming from a family of entertainers (he too has acted on stage and camera), it’s not a stretch to say that the entertainment business is “in his blood,” which gives him familiarity with the unique needs and desires of people involved in the entertainment business.

Among his clients are the actor whose short film was selected by the 2007 Cannes Film Festival, the photographer whose work was featured at the Phoenix Herberger Theatre, the band who sold music to MTV’s programming division, the songwriter whose songs were used in several feature films and television, and the wordsmith whose feature article graces the cover of the 2007 collector’s issue of Desert Living Magazine.

    ERIC LEMASTERS

    Eric Lemasters is VP of Business Development at KOCH Entertainment Distribution. He is responsible for cultivating new physical and digital distribution agreements and maximizing the company’s digital audio and video initiatives. A seasoned music industry professional, Lemasters’ career highlights include working in key roles ranging from A&R to Sales and Marketing at independent labels such as Energy Records, Mechanic Records and Earache Records. In 1998, he launched his own cutting-edge music label, The Music Cartel, which is still active today. In 2003 he entered the world of merchandising with stints at Merchdirect, Blue Grape Merchandising, and most recently, Bravado Merchandising (a division of the Sanctuary Group), where he held the position of Head of New Media and ran the company’s E-Commerce and M-Commerce initiatives.

    Mr. Rosenthal received an Undergraduate Degree in History and a Masters Degree in International Affairs from The American University, a Juris Doctor Degree in Law from The Antioch School of Law (Editor, Antioch Law Journal), and a Master of Law Degree in International and Comparative Law from Georgetown University Law Center.

JENNIFER BURKE-SYLVA

Jennifer Burke Sylva is a music and convergence attorney in private practice who works in the area of entertainment and technology. Sylva represents authors, musicians, visual and recording artists, producers, record companies, as well as technology companies from the United States, Europe, and Japan.

Prior to founding the firm, Sylva served as head lawyer and executive with Sony Connect Inc., Sony’s online digital distribution venture, where her duties included obtaining rights from major and independent record labels, motion picture studios and production companies, television networks, recording artists, publishers and other rights holders. She has drafted and negotiated numerous music and video content, software and technology license agreements, prepared policies, services and online agreements for Web sites and in support of e-commerce, and provided legal advice to multiple business units within the company in the US, Europe and Japan.

Prior to Sony Connect, Sylva worked as General Corporate Counsel for Redwood City-based Liquid Audio, Inc. and was also employed in private practice. Sylva was awarded a Bachelor of Arts from the University of California at Santa Cruz and was a scholarship recipient of and attended the University of Kent, Canterbury, England. She earned her Juris Doctorate from Santa Clara University School of Law. While in law school, Sylva served as an articles editor for, and was published in the High Technology Law Journal, earned the Pro Bono Award for her work with California Lawyers for the Arts, and earned the High Technology Law Certificate.
Sylva was awarded the First Place Nathan Burkan Memorial Writing Award by the American Society of Composers, Authors, and Publishers (ASCAP) for her article about digital distribution and content delivery. Prior to becoming a lawyer, Sylva was employed by Virgin Records in the U.K. and in Ireland.

Sylva publishes articles periodically and speaks on panels where she helps to educate others about music, copyright, and other intellectual property issues. Sylva is a member of the State Bar of California, a panel attorney for California Lawyers for the Arts, and the Chapter/Committee Relations Sub Committee Chair of the national Intellectual Property Committee of the Association of Corporate Counsel.




JASON KADLEC

Jason served as both Director of A&R and Director of Client Relations at INGrooves before being appointed Director of Business Development & Marketing in 2006. Prior to INgrooves, Jason worked for Om Records as Street Team Coordinator and toured and recorded with Om Records artist aFRO-mYSTiK.




TIM MITCHELL

Tim Mitchell started at IODA when the company was only 9 strong and has performed more than one dual-executive role as the VP of Business and Product Development and VP of Marketing and Business Development. As VP of Marketing, Tim now leads the company’s focused effort on the next big challenge in the digital media space.

In 1996, Tim started his Internet career at Wired Magazine and soon moved to Hotwired, the first commercial media Web site. In 1998 he founded grassroots Web-casting site Nineup.com to showcase local San Francisco artists using the then-new power of streaming media before “streaming media” was even a buzzword. He held product management roles at Lycos Music, while also hosting the Wired News online radio show “Music Spin” and acting as a member of the Board of the Popular Noise Foundation, a San Francisco based non-profit whose goal was to promote local independent musicians. Later, he held a strategic product development role as Terra/Lycos in their Global Product Development group where he worked heavily in streaming media and media player software.

Recently Tim re-launched MP3.com at CNET Networks as the site Director in May 2004. There, he was responsible for managing MP3.com, its business strategy and technologies. He played a key role in the re-launch, providing a new brand, focus, strategy and directive.

Tim is well-versed on the important issues of the day with 9 year’s experience in the digital music space and has a long list of speaking engagements and quotes in the press. Speaking engagements include: Jupiter, Music 2.0, iHollywood, Mobile Content World, East Coast Music Awards, CMJ, London Calling, Bandwidth, Billboard Mecca, TapeOp, Podcast Hotel and others.

Day job aside, Tim spends many of his off-hours writing, recording and performing music.



GEOFF PIPER

Geoff Piper has managed various jazz, country and rock groups. He currently performs with and manages a Bay Area alternative rock band. His management duties include advising on national booking and touring, publicity, public relations and advertising, artist Web site and online presence development, the selection of artistic and musical material, wardrobe, organization of photo and video shoots, and all other matters pertaining to the band’s professional activities and career in the entertainment, music and recording industries. Geoff also works for Independent Television Service (ITVS) in San Francisco as an Intellectual Property (IP) attorney in-house where he negotiates and drafts television production and distribution contracts in order to license content between independent film producers, artists, broadcasters, distributors, television stations, recording companies, and music publishers. Prior to ITVS, Geoff worked for several San Francisco based IP law firms, solo practitioners, and in his own private practice where he represented solo artists, bands, music studios, independent online labels and distributors.

ABOUT THE SPEAKERS:

TODD COOPER

Todd Cooper is Of Counsel with Greenberg Traurig’s Entertainment Practice Group. His practice focuses on music industry, multimedia and intellectual property issues. He is experienced in a wide range of music and multi-media transactions and has represented individuals and companies on intellectual property matters including recording artists, songwriters, producers, personal managers, event producers, models and record executive employment agreements. Todd has negotiated recording, distribution, and various other agreements with both major and independent record labels as well as negotiated co-publishing, sub-publishing and songwriter agreements with music publishers and has experience in complex acquisitions and sales of entertainment catalogs. Previously, Todd worked as a recording engineer for a major Los Angeles recording studio, as a road and production manager for various touring artists as well as a personal manager for a prominent Los Angeles-based company. Todd earned his J.D. at Loyola Law School and holds a B.A. in History from UCLA. He is admitted to practice in California.

MIKE GORMLEY

Music industry veterans Mike Gormley and Jolene Pellant have teamed up to form a new management/marketing/music publishing company. The new firm is called Yes, Dear Entertainment.

Gormley has been President of L.A. Personal Development since 1987. Prior to that Gormley was partners with Miles Copeland in L.A. Personal Direction. Both were affectionately referred to as L.A.P.D.

On the marketing side Yes, Dear currently represents Mediabase, the largest radio airplay monitor in North America, and Orsino Publicity whose music program is heard in eighty-five art house movie theatre auditoriums around the country including the Laemmle Theaters, Angelika and City Cinemas.

A native of Ottawa, Mike has managed several major acts from their early days through to major international recognition including The Bangles and Oingo Boingo. Boingo front man Danny Elfman has become a major film composer with help from Gormley, who convinced him to do the music for “Pee Wee’s Big Adventure” more than twenty years ago. Danny is now one of the top five composers in the film world having scored such gems as “Beetlejuice,” the first two Batman movies, “Spiderman,” “The Red Dragon” and “Chicago.” His work on “Good Will Hunting” and “Men In Black” each earned Danny an Academy Award nomination.

Other popular artists Mike has managed include Wall Of Voodoo (who had top 40 hits such as “Mexican Radio” and other major success throughout Europe and Australia), African star Angelique Kidjo and Concrete Blonde. The latter is a multi﷓-platinum act in various parts of the world and best known in the U.S. for their Top 20 hit “Joey.”

Although not in the A&R field, Mike was instrumental in the signing to Mercury Records of the legendary New York Dolls and Kraftwerk. He also oversaw the campaigns for Thin Lizzy, The New York Dolls, Rush, Bachman﷓-Turner Overdrive, The Runaways, The Ohio Players, and many others before moving to Los Angeles with A&M Records.

At A&M Mike rose to the post of Vice President of Publicity and Assistant to the Chairman. There he worked with The Police, Supertramp, Herb Alpert and others. Mike also teaches a class at UCLA Extension entitled “The Insider’s Guide to Music Management”, is on the boards of the National Folk Alliance and the Music Manager’s Forum, and on the advisory committee for management and legal work for AFTRA.

MICHAEL A. ACZON

San Francisco Bay Area based Michael A. Aczon has practiced entertainment law and personally managed select clients since 1983. As a lawyer, he has represented a variety of clients in virtually every musical genre from unsigned local artists to multi-platinum artists and writers to L.A. and Nashville-based companies. Says San Francisco Examiner’s Edie Sellers, Aczon is “bright, funny and supremely knowledgeable. TONY BERMAN

Tony Berman is the founder of Berman Entertainment and Technology Law, a law firm focusing on issues implicated by the convergence of technology and the entertainment industry. His primary practice areas involve negotiation of entertainment contracts and advising clients on legal issues involved in the formation of entertainment-related organizations and protection of copyrights and trademarks. His clients include record companies, online content distribution companies, management companies, film and television production companies, presenters of live entertainment, music venues, publishers, multimedia companies, multimedia developers, producers, technologists and industry executives as well as writers, performers and artists.

Tony is the editor-in-chief of Multimedia & Entertainment Law Online News (MELON) and a contributing editor to Entertainment Industry Contracts, published by Matthew Bender. He was the chair of the Sports and Entertainment Law Section of the Bar Association of San Francisco from 1998 through 1999. Tony is also an adjunct professor at Golden Gate University School of Law where he teaches Negotiating and Drafting Contracts in the Entertainment Business.

Tony received his A.B. from New York University, and his J.D. from New York Law School.

He frequently speaks at entertainment industry conferences including the South By Southwest Music & Media Conference, the Summer Music Conference, the Bandwidth Conference, the Global Entertainment and Media Summit, the Music Law Summit West, the Future of Music Policy Summit, California Lawyers for the Arts Music Business Seminar and the Streaming Media Conference.

MARC H. GREENBERG

Marc H. Greenberg is a veteran intellectual property and business attorney who joined the Golden Gate faculty in 2000 as the first Director of the Law School’s Intellectual Property Program. Professor Greenberg teaches Internet and Online Law, Entertainment Law, Survey of Intellectual Property Law, Content Licensing Law, Film & Television Law, and a required course in Corporations Law. He is a frequent lecturer, with presentations to the ABA Section on IP Law, MCLE programs, and to a wide array of community IP and arts groups. He is the author of the article, A Return to Liliput: The Licra v. Yahoo! Case and the Regulation of Online Content in the World Market in 18 Berkeley Technology Law Journal 4 (Fall 2003) 1191, and The Baby and the Bathwater Too: A Critique of ALA v. U.S., published in the October 2005 online issue of Syracuse University Law School’s Science and Technology Law Journal. His most recent work, Reason or Madness: A Defense of Copyright’s Growing Pains, an article regarding the conflict between Copyright and First Amendment jurisprudence, is circulating for publication.

Before joining the full-time faculty, Professor Greenberg was an adjunct professor for eight years, teaching Internet and Online Law, Multimedia Law and Entertainment law. As a founding partner of San Francisco boutique firm Nelsen, Greenberg & Cohen, he spent twenty-five years in private practice focused on advising new technology companies and transactional work and litigation in website development, e-commerce, licensing, copyright, trademark, and entertainment law. Professor Greenberg continues to practice law on a limited basis for a select group of clients, handling mostly transactional matters. He also serves as an expert witness and consultant on intellectual property law issues. He is a member of the ABA Section on Intellectual Property Law, The California Bar Section on Intellectual Property Law, and a past co-chair of the Copyright Section of the San Francisco Intellectual Property Law Association.



GEOFF PIPER

Geoff Piper has managed various jazz, country and rock groups. He currently performs with and manages a Bay Area alternative rock band. His management duties include advising on national booking and touring, publicity, public relations and advertising, artist Web site and online presence development, the selection of artistic and musical material, wardrobe, organization of photo and video shoots, and all other matters pertaining to the band’s professional activities and career in the entertainment, music and recording industries. Geoff also works for Independent Television Service (ITVS) in San Francisco as an Intellectual Property (IP) attorney in-house where he negotiates and drafts television production and distribution contracts in order to license content between independent film producers, artists, broadcasters, distributors, television stations, recording companies, and music publishers. Prior to ITVS, Geoff worked for several San Francisco based IP law firms, solo practitioners, and in his own private practice where he represented solo artists, bands, music studios, independent online labels and distributors.

Mr. Winogradsky is an adjunct professor at California State University, Northridge (CSUN) in the Masters degree program in Music Industry Administration and was also named as one of the Outstanding Instructors in Entertainment Studies and Performing Arts at UCLA Extension, where he has taught since 1997.

ABOUT JOE POINDEXTER
A&R Executive:

Joe Poindexter has amassed diverse experience in his 6 years in the music business. He grew up in Lincoln, NE with early intentions of becoming a politician, but his plans for the future quickly changed after being introduced to the music business at the University of Illinois at Urbana-Champaign. Joe’s career in the music business began as a College Representative for the Universal Music Group, where he spent hours canvassing the University’s campus with posters and stickers for the company’s priority artists. He also tracked radio airplay and coordinated events for Universal artists that came through town on tour.

Graduating in 2000, Joe relocated to Los Angeles with a job opportunity in the sales department at Columbia Records. He helped break artists like Pete Yorn, John Mayer, Five For Fighting, Lostprophets and Crazy Town, through aggressive artist development retail campaigns. In his tenure at Columbia Records, Joe expanded his knowledge about the distribution side of the music business and learned how important artist development can be.

After Columbia Records, Joe received an offer from Q Prime Management (Metallica, Red Hot Chili Peppers, Shania Twain, Muse, Nickel Creek, Gillian Welch). While at Q Prime, Joe was exposed to the world of artist management, radio promotion, and tour marketing. It was a tremendous learning experience at Q Prime and helped diversify Joe’s knowledge of the “complete” music business.

Joe accepted an offer to become the Director of A&R at Elementree Records (a Geffen Records imprint), and spent 3 years there. He took on A&R responsibilities for Deadsy, a band fronted by Elijah Blue Allman (son of Cher and Greg Allman) who Jonathan Davis of Korn discovered back in 1999. He also signed The Drama and worked with The Suicide Girls. His experience at Elementree Records allowed him to diversify his relationships in the music business.

Joe intends to lead the next generation of executives in the music business by combining forward thinking with a preservation of the ideals set out by the first generation.

ABOUT HEATHER KREAMER

Heather Kreamer is Director of Music for Create Advertising, an entertainment marketing company. She oversees all music needs for both their Los Angeles and London offices. This includes finding and licensing the perfect commercial music, as well as working with composers to create custom scores. Prior to joining Create, Heather spent 5 years running the music department of mOcean, another entertainment marketing agency. Her background includes building the film and television department for INgrooves, a global music distributor. She began her music career at Natural Energy Lab, where she signed artists and marketed their music for sync placements. Heather has worked on hundreds of successful motion picture marketing campaigns. Some recent ones include The Amazing Spiderman 2, Monument’s Men and I Origins.

Angela Rose White is an attorney from Los Angeles, California, USA, who has concentrated on music publishing/administration for the last 15 years as COO of David Rose Publishing Co. which has a catalog of over 500 songs spanning 60 years; this catalog includes smash hits “The Stripper” and “Holiday For Strings” as well as several TV themes/cues, film scores and classic songs which have been performed, recorded, and licensed throughout the world. White’s father, David Rose, was a founding member of the Association of Independent Music Publishers (AIMP). In 2009, White founded Rose Music Services, LLC d/b/a DaBet Music Services to provide songwriters, publishers and their estates with various services regarding catalog management including administration, licensing, royalty analysis, collections and communication with third parties, both inside and outside the U.S. In 2012, White changed her company’s focus after discovering that songwriters/publishers or their heirs and representatives were frequently not aware of the fundamental rights related to song ownership and copyrights. DaBet Music Services now serves primarily as a consulting company to heirs, executors, attorneys, estates and publishers. It provides organization and basic evaluation of music catalogues, copyrights, income streams and management for music catalogs. ABOUT MICHAEL HILL

Michael Hill supervises the music for the critically acclaimed Showtime series Nurse Jackie (now in its 6th season and returning to a 12-episode arc) and supervised all three seasons of the HBO series Bored To Death. He is currently working on Laggies, a romantic comedy with Keira Knightley, directed by Lynn Shelton (Touchy Feely, Hump Day). Among his recent projects are A.C.O.D., a comedy starring Adam Scott, set for an October release, and Plus One, a teen-oriented horror film scheduled for September release by IFC Films. He also worked on writer-director Ramin Bahrani’s At Any Price with Zach Efron and Dennis Quiad, released in April by Sony Pictures Classics. Recent pilots have included Life&Kids with Debra Messing for CBS and The Untitled Michael Lannan Project for HBO. Previous film work includes Todd Solondz’s Dark Horse, John Cameron Mitchell’s Short Bus and Last Chance Harvey with Dustin Hoffman. Michael is also program director for the non-profit Musicians On Call, which brings live music to healthcare facilities throughout New York City, and helps to curate the annual Tibet House Benefit Concert at Carnegie Hall, under the artistic direction of Philip Glass. Michael began a career in music supervision after 15 years in A&R at Warner Bros. Records, where he worked with such artists as the Replacements, Luka Bloom and Soul Coughing. He also writes about music, most recently contributing liner notes to a boxed set of Tindersticks’ scores for the films of Claire Denis.

Angela Rose White is an attorney from Los Angeles, California, USA, who has concentrated on music publishing/administration for the last 15 years as COO of David Rose Publishing Co. which has a catalog of over 500 songs spanning 60 years; this catalog includes smash hits “The Stripper” and “Holiday For Strings” as well as several TV themes/cues, film scores and classic songs which have been performed, recorded, and licensed throughout the world. White’s father, David Rose, was a founding member of the Association of Independent Music Publishers (AIMP). In 2009, White founded Rose Music Services, LLC d/b/a DaBet Music Services to provide songwriters, publishers and their estates with various services regarding catalog management including administration, licensing, royalty analysis, collections and communication with third parties, both inside and outside the U.S. In 2012, White changed her company’s focus after discovering that songwriters/publishers or their heirs and representatives were frequently not aware of the fundamental rights related to song ownership and copyrights. DaBet Music Services now serves primarily as a consulting company to heirs, executors, attorneys, estates and publishers. It provides organization and basic evaluation of music catalogues, copyrights, income streams and management for music catalogs. This new business model has led the DaBet team to act as “music detectives” who diligently research titles, sources of royalties, historical trails for music copyrights, and past and current activity (licensing). The ultimate goal: To eliminate any roadblocks and ensure authors and composers are paid correctly. DaBet consists of three publishing entities: Taste This Music (ASCAP), Vintage Gold (BMI) and Mel’s Taste (SESAC).

Les Scott is a veteran of the music industry and is uniquely positioned to help NARIP members in Phoenix identify opportunities within this business. His publishing company Source Q Boutique specializes in music placement in film & television, and currently represents over 350 writers/artists. SQB is exclusively marketed through its alliances Crucial Music Group, Fuze Artz and Expressive Artists. Mr. Scott consults on intellectual property and other legal matters such as band agreements, record contracts, writer collaborations, performance releases, cue sheets and other custom agreements. As a producer, he is commissioned to write and produce songs for such companies as BMG, FirstCom, Universal Music Group and Network, and has produced over 125 artists/bands in all genres. Thanks to Berlin Goes SXSW and Berlin Music Week, we have a limited number of complimentary passes for NARIP’s Music Supervisor Session in Austin at SXSW.

These sessions have sold out two years in a row at Berlin Music Week (featuring Gary Calamar, Andrea von Foerster, Angela Leus and Heather Kreamer), and due to demand, we make this special LIMITED ENROLLMENT program available to you at SXSW as well.

Music Supervisor Andrea von Foerster is our special guest at this NARIP Music Supervisor Session who will be in Austin seeking music for her current projects. Andrea commissions, licenses and places music for global feature films as well as for independent films and television. Andrea has done music supervision for film, television and online projects for over ten years. Credits include music documentaries such as The White Stripes Under Great White Northern Lights and Butch Walker: Out Of Focus. Independent films such as (500) Days Of Summer, It’s Kind of A Funny Story, From Prada To Nada, Bellflower and Excision. Studio film credits include Journey 2: The Mysterious Island, Chronicle and Chasing Mavericks. Television work includes The O.C., Grey’s Anatomy, Dollhouse and Stargate Universe and numerous MTV shows such as Run’s House and Life Of Ryan. She is working on the independent films Friended To Death and Growing Up And Other Lies in addition to the Hallmark Hall of Fame TV movie Remember Sunday, the second season of the Web series Suit Up, Modern Family and two TV pilots.

Mr. Ronco Johnson, a native of Marietta, Georgia and Kennesaw State University alumni, serves as President and CEO of L.R. Johnson & Associates, Inc., and the founder of The Ronco Johnson Foundation for Financial Literacy. L.R. Johnson & Associates, Inc. is an insurance and financial services consulting firm that specializes in sophisticated insurance planning for affluent individuals, athletes, entertainers, and business professionals for the purpose of minimizing potential tax issues using the tax advantages of life insurance products. Eric Newcomer

Born in the small Western Maryland town of Cumberland, Eric was exposed to music at an early age from his grandfather gathering with friends for jam sessions on the front porch to his mother performing in a band. He developed an appreciation for the business side, starting his journey to find, develop and foster emerging artists. Now in Atlanta, Georgia for 23+ years he is entrenched in the entertainment community as a member of The Recording Academy’s Atlanta Chapter, as well as the Georgia Music Partners and sits on Board for the National Association for Record Industry Professionals. A graduate of the Art Institute of Atlanta’s Music Business Institute. Eric has worked with production companies on events including concerts for Bon Jovi, Bruce Springsteen, Fleetwood Mac, Puff Daddy (at the time), George Strait, Alan Jackson, Smashing Pumpkins, Seether, Puddle of Mud, the Eagles, the Rolling Stones Steel Wheel Tour, as well as Music Midtown where he worked on stage with Sheryl Crow, Bob Dylan, Godsmack, Evanescence, Shinedown, Jack Johnson, Ben Harper, Cowboy Mouth and others. He then designed the Downtown Sounds LIVE! concert series and is ready to launch the second year in association with a few key partnerships. His involvement in film and television has garnered him opportunities to perform in Livin’ Large, The Rose and The Jackal, Glory, Drop Dead Diva, and What To Expect When Expecting. Set up for distribution and several touring situations with established national artists through CAA, Eric is constantly on the lookout for committed, focused talent. His passions don’t stop there. He is very passionate about OUR Earth and the way we treat it. He is developing a plan to include a multi-city tour to empower and entertain. The tour will educate young and old on the importance of being environmentally conscious, how to live healthy and make a difference.
